      民营经济促进法作为中国首部专门针对民营经济发展的综合性立法,是社会主义市场经济体系的基础性法律之一,也是对现行民商法与经济法体系的必要补充。其功能定位既是民营经济宪法权利的彰显法,也是民营经济组织与经营者权利的保护法。该法设立了多项促进民营经济组织发展的创新制度,但其有效实施仍然面临诸多现实挑战。未来,应进一步加强该法与现行法律体系的协调,完善配套法规和实施细则,并强化法律适用的实践监督,以确保其真正发挥促进民营经济发展作用的立法初衷,为构建高水平社会主义市场经济体制提供坚实的法治支撑。

英文摘要:

      As China's first comprehensive legislation specifically targeting the development of the private economy in China, the Private Economy Promotion Law constitutes one of the foundational laws of the socialist market economy system and a critical complement to the existing civil, commercial, and economic legal frameworks. The core function of this law lies in both affirming the constitutional rights of the private economy and protecting the rights of private economic entities and their operators. This law has introduced several innovative systems aimed at fostering the growth of private economic entities; however, its effective implementation continues to encounter numerous practical challenges. Therefore, in the future, it is crucial to further facilitate the alignment of this law with the existing legal framework, refine supporting regulations and implementation rules,and reinforce practical oversight over the application of the law, thereby ensuring that it fully realizes its legislative purpose of promoting the development of the private economy and legally underpins the establishment of a high-level socialist market economy. 
