      随着现代物流的发展,物流环境污染损害赔偿案件不断发生,作为一种特殊的侵权,其有别于传统的民事责任制度。通过分析现有民事责任制度不适合物流环境赔偿之处,借鉴国外一系列新的民事责任因果关系学说,提出明确规定推定因果关系、明确规定举证责任倒置、扩大环境民事侵权范围、增加物流环境民事责任社会化因素等物流环境民事责任立法构成要件方面完善,旨在完善环境民事责任制度。

      With the development of modern logistics industry, the compensation cases of logistics environmental tort are increasing. As a peculiar tort, the logistics environmental tort is different from traditional tort. This paper analyzes the existing systems of civil liability which however cannot adapt to the compensation in logistics environmental tort. Using a series of new civil liability causality theory on environmental tort abroad, it puts forward the suggestions on the legislative constituents to stipulate clearly the putative causality, stipulate clearly the reverse burden proof of onus probandi in environmental tort, enlarge the scope of the environmental tort, and increase the social element of civil liability for logistics environmental tort with the aim to improve the civil liability system for logistics environmental tort.
