      2008年9月爆发的三鹿奶粉事件向人们昭示,我国的食品安全形势不容乐观。通过梳理我国当前多部门共同负责的食品安全监管制度,可以发现其中存在的一些主要问题,包括法律制度建设滞后,监管职责不固定,食品药品监管部门定位不清,分段监管体制弊端明显,食用农产品初级生产阶段监管失控等。尽快出台构造科学的食品安全法是解决当前制度困境的一个重要条件。另外,强化问责制,理顺监管体制,强化食品链源头和终端的监管等也是完善监管体制的有效措施。

      The scandal of Sanlu baby milk formula in September,2008 indicates the fact that the fond safety in China is far from optimistic.Analyzing China's food safety regulatory system jointly responsible bv many departments,this paper identifies some key problems of the system:the food safety law is lagging behind;the regulatory roles are often changing;the orientation of fired regulatory system is unclear;divided-by-links and regulated system has obvious shortcomings:the agricultural products for haman consumption are out of control at the stage of primary production.This paper argues that a scientific fired safety law should be promulgated as soon as possible to solve the institutional dilemma.Moreover,there are also effective measures to improve the regulatory system such as strengthening the accountability,reconstructing the regulatory system,intensifying the supervision over the source and the terminal in food chain,etc.
